Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Er sollte in der kommenden Legislaturperiode ein umfassendes Fortpflanzungsmedizingesetz schaffen. (shrink)

Despite non/minimal adversarial feminist argumentation models heavily critiquing rude, hostile, uncooperative argumentative practices, I argue that these models slip easily into instances of ‘white talk’ when white individuals are engaged with BIPOC on matters concerning racial injustices. While these models address overt aggression, a more nuanced modification is needed for the models to handle cases of white passive aggressive argumentative tactics. Moreover, I also argue that given the language and argumentative ideology within academia, ‘white talk’ cannot be addressed by BIPOC (...) without ‘argumentative smothering.’ Building heavily from Dotson’s conception of ‘testimonial smothering,’ I argue argumentative smothering occurs when an interlocutor heavily modifies their argumentative practices due to an oppressive environment in an attempt to situate their argument in such a way that it will be receptive and ‘acceptable’ to the other interlocutor and/or audience. In light of the January 6, 2021, insurrection on the Capitol, this article considers the Second Amendment as an example of how Black women are quasi-citizens within the United States. I focus on the Second Amendment to not only give an account of the historical and contemporary ways guns are used to terrorize Black women but to also show the jeopardization possessing and carrying firearms pose to Black women in both individuated and systemic cases. By turning to the Second Amendment, (...) Black women’s status as citizens illuminates a liminal space where they are simultaneously inside the category of citizens but functionally excluded. Given the unjust foundations of the Second Amendment, I view Black women brandishing firearms as possibly an act of civil disobedience. (shrink)

A geographically stratified cross-sectional survey was conducted in 2002 to investigate household-level factors associated with use of mosquito control measures and self-reported malaria in Malindi, Kenya. A total of 629 households were surveyed. Logistic regressions were used to analyse the data. Half of all households (51%) reported all occupants using an insecticide-treated bed net and at least one additional mosquito control measure such as insecticides or removal of standing water. Forty-nine per cent reported a history of malaria in the household. (...) Of the thirteen household factors analysed, low (OR=0·23, CI 0·11, 0·48) and medium (OR=0·50, CI 0·29, 0·86) education, mudcoral (OR=0·0·39, CI 0·24, 0·66) and mud block–plaster (OR=0·47, CI 0·25, 0·87) wall types, farming (OR=1·38, CI 1·01, 1·90) and travel to rural areas (OR=0·48, CI 0·26, 0·91) were significantly associated with the use of mosquito control, while controlling for other covariates in the model. History of reported malaria was not associated with the use of mosquito control (OR=1·22, CI 0·79, 1·88). Of the thirteen covariates analysed in the second model, only two household factors were associated with history of malaria: being located in the well-drained stratum (OR=0·49, CI 0·26, 0·96) and being bitten while in the house (OR=1·22, CI 0·19, 0·49). These results suggest that high socioeconomic status is associated with increased household-level mosquito control use, although household-level control may not be enough, as many people are exposed to biting mosquitoes while away from the house and in areas that are more likely to harbour mosquitoes. Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. From the technical point of view, this comprises new input/output media for interaction with the machine as well as new software tools for help systems. From the organisational point of view, concepts for group work are to be supported and a methology for participation of users in the development process is suggested. A software tool for job order planning is presented which combines organisational and technical aspects. We owe the problem of the speckled hen to Gilbert Ryle. It was suggested to A.J. Ayer by Ryle in connection with Ayer’s account of seeing. Suppose that you are standing before a speckled hen with your eyes trained on it. You are in good light and nothing is obstructing your view. You see the hen in a single glance. The hen has 47 speckles on its facing side, let us say, and the hen ap­ pears speckled to you. On (...) Ayer’s view, in seeing the hen, you directly see a speckled sense-datum or appearance. Ryle wondered how many speckles there are on the sense-datum. After all, intu­ itively, the hen does not appear to you to have 47 speckles. And if this is the case, then it does not present to you an appearance with 47 speckles. Equally, however, the hen does not appear to you not to have 47 speckles. Animal ethicists have recently debated the ethical questions raised by disenhancing animals to improve their welfare. Here, we focus on the particular case of breeding hens for commercial egg-laying systems to become blind, in order to benefit their welfare. Many people find breeding blind hens intuitively repellent, yet ‘welfare-only’ positions appear to be committed to endorsing this possibility if it produces welfare gains. We call this the ‘Blind Hens’ Challenge’. In this paper, we argue that there are both empirical and (...) theoretical reasons why even those adopting ‘welfare-only’ views should be concerned about breeding blind hens. But we also argue that alternative views, which (for example) claim that it is important to respect the telos or rights of an animal, do not offer a more convincing solution to questions raised by the possibility of disenhancing animals for their own benefit. This study described the relationships between academic class and student moral sensitivity and reasoning and between curriculum design components for ethics education and student moral sensitivity and reasoning. The data were collected from freshman (n = 506) and senior students (n = 440) in eight baccalaureate nursing programs in South Korea by survey; the survey consisted of the Korean Moral Sensitivity Questionnaire and the Korean Defining Issues Test. The results showed that moral sensitivity scores in patient-oriented care and conflict were (...) higher in senior students than in freshman students. Furthermore, more hours of ethics content were associated with higher principled thinking scores of senior students. Nursing education in South Korea may have an impact on developing student moral sensitivity. Planned ethics content in nursing curricula is necessary to improve moral sensitivity and moral reasoning of students. (shrink)

"Notes toward a metaphysic of wonder" is the outcome of a "Reciprocal Inquiry" in which Leoni Henning and I participated. In our correspondence, we moved very fast: I thought each of us surprised the other. As a result, I found myself writing about astonishment more elaborately than I'd intended to. Before long I was involved not only with wondering but with awe and bewilderment and amazement, and eager to connect it all with philosophy in Latin America. So these "Notes..." (...) are just a foretaste of what I hope will someday be a more extensive article, but which is only hinted at in the present version. Leoni Maria Padillha Henning’s thoughtful and informative paper, “Pragmatism in Matthew Lipman and its influence in Latin America” is singularly helpful in showing the relevance of Philosophy for Children to Latin-American education. Indeed, the intellectual momentum it generates is a powerful invitation to other educators and scholars to take up the issues where she leaves off. I’d like to take up just one of these issues, one that, on the surface at least, seems to be particularly unpromising. I’m referring to the near-unanimity that exists among scholars with regard to the tradition, descended from Aristotle, that philosophy begins in wonder. My intention is not to attempt to refute this claim, but to show its complicity in defending the traditional non-reflective paradigm of education, which has sturdily resisted the introduction of philosophy into the schools, just as it resists the conversion of the classroom into a community of inquiry. With the proper pedagogy, philosophy can readily be taught to children, and the teaching of philosophy for children can readily be taught to teachers. It is not essential that wonder precede philosophy: it can just as well follow it. (shrink)

Wie aber kann das gelingen? In vielen verfügbaren Unterrichtsmaterialien werden argumentative Fähigkeiten eher vorausgesetzt als systematisch gefördert. Auch curriculare Vorgaben bleiben zumeist sehr unspezifisch. Lehrpersonen werden so weitgehend allein gelassen mit der Aufgabe, Lernende beim (...) Erwerb argumentativer Fähigkeiten zu fördern. Die vorliegende Aufgabensammlung soll dazu beitragen, diese Lücke zu schließen. Sie bietet Lehrpersonen reichhaltige Materialien für die spiralcurricular angelegte, systematische Förderung argumentativer Fähigkeit anhand exemplarischer Inhalte. Orientiert an klaren fachlichen Standards finden sich hier Aufgaben auf vier Niveaustufen, jeweils in Verbindung mit übersichtlichen Merkblättern. Die Aufgaben der beiden unteren Niveaustufen lassen sich bereits für jüngere Lernende der Sekundarstufe einsetzen, Aufgaben der obersten Niveaustufe richten sich an Lernende von Abschlussklassen oder der Studieneingangsphase. Beliefs about the moral status of children have changed significantly in recent decades in the Western world. At the same time, knowledge about likely consequences for children of individual, parental, and societal choices has grown, as has the array of choices that (prospective) parents may have at their disposal. The intersection between these beliefs, this new knowledge, and these new choices has created a minefield of expectations from parents and a seemingly ever-expanding responsibility towards their children. Some of these new (...) challenges have resulted from progress in genetics and neuroscience. It is these challenges that we focus on in this introduction and volume. (shrink)

Bioethicists tend to focus on the individual as the relevant moral subject. Yet, in highly complex and socially differentiated healthcare systems a number of social groups, each committed to a common cause, are involved in medical decisions and sometimes even try to influence bioethical discourses according to their own agenda. We argue that the significance of these collective actors is unjustifiably neglected in bioethics. The growing influence of collective actors in the fields of biopolitics and bioethics leads us to pursue (...) the question as to how collective moral claims can be characterized and justified. We pay particular attention to elaborating the circumstances under which collective actors can claim ‘collective agency.’ Specifically, we develop four normative-practical criteria for collective agency in order to determine the conditions that must be given to reasonably speak of ‘collective autonomy’. For this purpose, we analyze patient organizations and families, which represent two quite different kinds of groups and can both be conceived as collective actors of high relevance for bioethical practice. Finally, we discuss some practical implications and explain why the existence of a shared practice of trust is of immediate normative relevance in this respect. (shrink)

Discussions focusing on the relation between city and sexuality are rare in social and cultural studies. In this article I argue that the modern city is inherently and inevitably sexualized, and that modern sexuality is largely an urban one. The characteristics of this sexuality are described and discussed in the light of urban life world theory (Simmel, Wirth, Kracauer, Benjamin etc.), sexual constructionist theory, feminist analyses, gay studies and pornography. The particular quality of `sexuality' in urban sexualization is identified along (...) Heideggerian lines as a fundamental ` Gestimmtheit' (`being tuned') of modern being-in-the-world, that is of being-in-the-city. In conclusion, some implications of the intimate relation between city and sexuality are discussed. Thus, theories of everyday life and life world, as well as prevailing idioms of modernist and postmodernist cultural critique, are problematized. Throughout the article, the style and methods of the exposition comment on the problematics concerning the representation of sexuality; and trends towards a `discoursification' of sexuality are criticized. Since its founding in 1950, the Metaphysical Society of America has remained a pluralistic community dedicated to rigorous philosophical inquiry into the most basic metaphysical questions. At each year’s conference, the presidential address offers original insights into metaphysical questions. Because it is often argued that surrogacy should not be treated as contractual, the question arises in which terms this practice might then be couched. In this article, I argue that a phenomenology of surrogacy centering on the notion of trust provides a description that is illuminating from the moral point of view. My thesis is that surrogacy establishes a complex and extended reproductive unit––the “surrogacy triad” consisting of the surrogate mother, the child, and the intending parents––whose constituents are bound (...) together by mutual trustful commitments. Even though a trust-based approach does not provide an ultimate answer to whether surrogacy should be sanctioned or prohibited, it allows for at least some practical suggestions. In particular, I will argue that, under certain conditions, surrogacy is tenable within familial or other significant relationships, and I will stress the necessity of acknowledging the new relationships and moral commitments that result from this practice. Als Theorie des Guten fordert der Perfektionismus eine gelingende menschliche Entwicklung; als politische Philosophie stellt er Institutionen die Aufgabe, die Entfaltung der Individuen zu ermöglichen. Eine solche Politik steht heute allerdings unter liberalem Generalverdacht. Christoph Henning stellt die Debatten um den Perfektionismus erstmals umfassend dar und zeigt im Rückgriff auf radikale Denker von Jean-Jacques Rousseau bis Thomas Hurka, dass der Perfektionismus als zentraler Bestandteil des Projektes von Freiheit und Gleichheit zu begreifen ist.

Mental manipulation, as an extension of object manipulation, provides a continuous, biologically based concept for studying G as it pertains to individual differences in humans and other species.
